Welcome to Monara Note. By accessing or using our application, you agree to be bound by these Terms of Service. Please read them carefully before using our services.

1. Acceptance of Terms

By downloading, installing, or using Monara Note, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our application.

2. Eligibility

Monara Note is intended for users who are 18 years of age or older. By using this application, you represent and warrant that you are at least 18 years old. We do not knowingly provide services to individuals under 18 years of age.

3. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the Monara Note application on your personal iOS device
• Access and use the application for your personal, non-commercial purposes
• Access content and features available through the application

4. User Conduct

You agree to use Monara Note in accordance with all applicable laws and regulations. You agree NOT to:

• Use the application for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the application's functionality
• Reverse engineer, decompile, or disassemble any part of the application
• Remove, alter, or obscure any proprietary notices from the application
• Use the application to harass, abuse, or harm others
• Upload or transmit viruses or malicious code

5. Subscriptions and Payments

Monara Note offers subscription-based access to premium features:

Payment Terms:

• All subscriptions are processed through Apple's App Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your Apple account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel your subscription through your Apple account settings
• No refunds will be provided for partial subscription periods

6. Intellectual Property Rights

All content, features, and functionality of Monara Note, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Monara Note or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

Your Content: You retain all rights to the artwork and content you create using Monara Note. We do not claim ownership of your creations.

7. AI-Generated Content

Monara Note uses artificial intelligence to provide drawing assistance and generate course content. While we strive for accuracy and quality:

• AI-generated content is provided "as is" without warranties
• We do not guarantee the accuracy, completeness, or suitability of AI-generated suggestions
• You are responsible for reviewing and validating any AI-generated content before use
• AI services are provided by third-party providers and subject to their availability

8. Third-Party Services

Monara Note integrates with third-party services including Groq AI, Pexels, and TMDB. These services are governed by their own terms and conditions. We are not responsible for the availability, accuracy, or content of these third-party services.

9. Disclaimer of Warranties

Monara Note is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the service will be uninterrupted, timely, secure, or error-free
• Warranties regarding the accuracy or reliability of any content or information

10. Limitation of Liability

To the maximum extent permitted by law, Monara Note and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the application
• Any unauthorized access to or use of our servers
• Any bugs, viruses, or other harmful code transmitted through the application
• Any errors or omissions in content or information

11. Account Termination

We reserve the right to suspend or terminate your access to Monara Note at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms of Service
• Fraudulent or illegal activity
• Extended periods of inactivity

You may delete your account at any time through the application settings. Upon termination, your right to use the application will immediately cease.

12. Modifications to Service

We reserve the right to modify, suspend, or discontinue any aspect of Monara Note at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

13. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of any material changes by posting the new Terms within the application or via email. Your continued use of Monara Note after such modifications constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Monara Note operates, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of Monara Note shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Monara Note regarding your use of the application and supersede all prior agreements and understandings.
